Is Delta-9 THC Legal in Delaware?
Delaware has joined the list of states legalizing adult-use cannabis, but hemp-derived THC remains governed by federal law and state interpretation.
Hemp-Derived Delta-9 THC
Under the 2018 Farm Bill, Delta-9 THC derived from hemp and within the 0.3% limit is federally legal. Delaware has not banned hemp-derived Delta-9, and it is generally accepted so long as it meets federal requirements.
However, products must not exceed THC limits and should be properly labeled and tested.
